Elise A. Fialkowski recently presented a seminar at the Advanced Corporate Immigration Law Conference sponsored by the New Jersey State Bar Association. Ms. Fialkowski presented as a panelist for the program “Interagency Challenges – Ever Changing Employment Issues,” at which issues related to conflicts between and among agency interpretations were discussed.
Many agencies are involved in the employment based immigration process. The Department of Labor, the United States Citizenship and Immigration Services, the Department of State and the United States Customs and Border Protection may all be involved in the immigration process required for a single employee to obtain an employment based visa and work authorization. The panel discussed the challenges when dealing with multiple agencies, including, for example, conflicts between agency processes and interpretations. The panel also provided practical guidance and advice regarding navigating the immigration process.
